First, Because Most Agents Bury It

You Are Never Tied InSeven Days, In Writing, And We Are Done

We do not hold our sellers to a minimum term. If you are not happy with us you may end the agreement at any time and take your property elsewhere. We would rather earn the instruction every week than own it for twelve.

0Weeks tied in

End the agreement whenever you like. Seven days’ notice, in writing.

2.4%Sole agency, inc VAT

2% plus VAT of the selling price. Nothing to pay unless and until contracts exchange.

£0Your cost for ID checks

The law requires them. They cost £45 including VAT and we pay, not you.

Our Fees

Three Types Of AgencyThree Different Fees

The fee is payable on unconditional exchange of contracts and is calculated on the selling price, to include any fixtures and fittings. VAT is charged at the rate in force on the day contracts exchange.

2.4%

Sole Agency

2% plus VAT. We are your only agent. Initial period 6 weeks, then until otherwise agreed.

3%

Joint Sole Agency

2.5% plus VAT. Us with one other named firm. Our fee may be shared with them on a pre-agreed basis.

3.6%

Multiple Agency

3% plus VAT. Us as one of several agents. Payable if contracts exchange with a buyer we introduced.

These Are Our Standard Fees

The fee written into your agreement is the one that applies to you. If we agreed something different with you, that figure governs, not the rate printed here.

No Sale, No Fee

Nothing is payable unless and until contracts are exchanged. If your property does not sell, you owe us nothing.

The Six Weeks

What It Does, And What It Does Not

You can instruct us in one of three ways — as your sole agent, as joint sole agent alongside one other firm, or as one of several under a multiple agency. The six weeks applies only to the first of those.

What It Does

If you instruct us as sole agent, then for the first six weeks we are your only agent. If the property is sold during those weeks to a buyer a second agent brought in behind us, our fee is still payable.

Why

Otherwise we could do the work, pay for the marketing, and watch somebody else collect.

What It Does Not Do

It does not stop you leaving — on any of the three types. It stops you being charged twice, and it stops us being cut out of our own sale.

Ending The Agreement

Whenever You LikeWith Seven Days In Writing

You may end the agreement at any time, including during the six-week sole agency period, by giving us seven days’ notice in writing. Either of us may end it on seven days’ written notice.

Ending the agreement does not by itself remove our right to a fee where a buyer we introduced goes on to exchange contracts.

We may end the agreement on one week’s written notice if our office ceases to trade, or if there is a change in ownership of the business.

Our Services

What We DoFrom The Day We Both Sign

We act as your sole, joint sole or multiple agent for the sale of the property from the date we have both signed the agreement.

We may advertise the property at our discretion, including on all the property portals, on social media and on occasion in local publications. We may, with your consent, appoint a sub-agent to help sell it.

We and our associated companies also offer surveys and valuations, utilities, conveyancing, auctions, lettings, property management and tenant referencing, for which we may receive a fee.

Identity Checks — What We Need, And Who Pays

We are required by law to confirm the identity of every seller and to keep a record of the evidence. For each owner we need photo identification — a driving licence or passport — your date of birth, and your primary address if it differs from the property you are selling.

The initial checks are carried out on our behalf by Lifetime Legal, who will contact you once you have agreed to instruct us. We remain responsible for making sure they are done correctly.

We Pay For Them

The checks cost £45 including VAT. We pay that, not you, in advance of publishing your property. It is non-refundable.

If we cannot confirm your identity, we reserve the right to withdraw the property from sale until formal proof is received. Required by the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017.

Two Questions The Law Requires

Estate Agents Act 1979

To avoid conflicts of interest, the Act requires us to be open about any connection between you — or anyone related or connected to you — and Element Properties Alexandra Park Ltd. When you instruct us we will ask you two questions in writing:

Are You Aware Of Any Such Connection Or Interest?

And if so, the details.

Are You The Legal Owner Of The Property?

And if not, in what capacity you are selling.

Your Conveyancer

We may recommend solicitors who have been carefully selected to provide conveyancing services, which may be offered to both parties in a transaction. We do not receive a fee for these referrals.

We comply with the Solicitors Introduction and Referral Code published by the Law Society. Any firm we refer you to is an independent professional company from whom you will receive impartial and confidential advice. You are free to choose another firm.

Accurate Particulars

We must ensure by law that the information supplied about your property is accurate and not misleading. Please confirm that everything in the sale particulars is correct, and tell us promptly if anything is wrong or changes later.

This duty sits in the unfair commercial practices provisions of the Digital Markets, Competition and Consumers Act 2024, which replaced the Consumer Protection from Unfair Trading Regulations 2008 on 6 April 2025.

Your Data, And Your Right To Cancel

Fourteen DaysAnd What Happens If You Use Them

Marketing Material And Your Data

We retain copyright in all advertising material used to market the property, and reserve the right to use it for marketing after the sale. If you would prefer we did not, tell us and we will not — there is a box on the agreement for exactly that.

How we handle your personal information is set out in our Privacy Notice.

Notice Of The Right To Cancel

You have the right to cancel the agreement within 14 days, starting the day you receive the notice. To cancel, write to us and deliver it personally or send it, which may be by email. A cancellation notice counts as given as soon as it is posted, or on the day it is sent by email. A cancellation form comes with the document, but you do not have to use it.

Read This With It

By signing, you ask us to begin marketing straight away. If a sale is agreed before you cancel and contracts are later exchanged, our fee is still due despite the cancellation. If you would rather we waited until the 14 days had passed before marketing, say so and we will wait.

Your cancellation rights are given by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
